    1. Acceptance of Terms

    By accessing or using ClarifyTube (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

    2. Description of Service

    ClarifyTube is a SaaS (Software as a Service) platform that provides AI-powered summaries of YouTube videos. The Service allows users to obtain summaries of videos, translate captions, and bookmark videos for later viewing, using credits allocated based on their chosen subscription plan.

    3. Eligibility

    You must be at least 13 years of age to use the Service. If you are under 18, you must have your parent or guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

    4. Account Registration and Security

    • Account Creation: To access certain features of the Service, you may be required to create an account. You agree to provide accurate, complete, and current information during the registration process and to update such information to keep it accurate, complete, and current.
    • Account Security: You are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. ClarifyTube will not be liable for any loss or damage arising from your failure to comply with this section.
    • Account Termination: We reserve the right to suspend or terminate your account at any time, for any reason, including but not limited to violation of these Terms.

    5. Subscription Plans and Payment

    • Subscription Plans: The Service offers various subscription plans on our pricing page. Credits are used to generate summaries and perform other actions within the Service.
    • Payment: Paid plans require payment through a third-party payment processor (Stripe). By subscribing to a paid plan, you authorize us (through Stripe) to charge your chosen payment method.
    • Billing Cycle: Subscription fees are billed weekly in advance. Your subscription will automatically renew each week unless you cancel it.
    • Credit Allocation and Usage: Credits are allocated at the beginning of each billing cycle (weekly). Unused credits do not roll over to the next billing cycle; they expire at the end of the current cycle.
    • Cancellation: You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing cycle. No refunds will be provided for a partial billing cycle. Access to the service and any remaining credits for the current cycle will continue until the cycle ends.
    • Upgrades and Downgrades: If you choose to upgrade your plan, the new plan pricing and credit allocation will take effect immediately, and you will be charged a prorated amount for the remaining time in your current billing cycle. If you choose to downgrade your plan, the new plan pricing and credit allocation will take effect at the start of your next billing cycle.
    • Price Changes: We reserve the right to change the pricing of our subscription plans and the credit cost for services at any time. We will provide reasonable notice of any price changes.
    • Free Plan: The free plan provides a limited number of credits per month.
    • Fair Use Policy: We reserve the right to limit the number of credits you can use in a given period to prevent abuse of the Service or if we suspect you are using bots or other automated tools to access the Service. The limit is around 500 credits per week.

    6. Usage Restrictions

    • Prohibited Conduct: You agree not to:
      • Use the Service for any illegal or unauthorized purpose.
      • Violate any applicable laws or regulations.
      • Attempt to circumvent any security measures of the Service.
      • Interfere with or disrupt the Service or servers or networks connected to the Service.
      • Use any automated means (e.g., bots, scrapers) to access the Service without our express written permission.
      • Attempt to reverse engineer, decompile, or disassemble any portion of the Service.
      • Share your account credentials with others.
      • Exceed the credit limits of your subscription plan.
      • Use the service to create summaries of videos that violate YouTube's Terms of Service.
    • Content Restrictions: You are solely responsible for the content you access and summarize using the Service. You agree not to use the Service to access or summarize content that is illegal, infringing, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

    7. Intellectual Property

    • Ownership: The Service and its original content, features, and functionality are and will remain the exclusive property of ClarifyTube and its licensors. The Service is protected by copyright, trademark, and other laws in various countries.
    • Limited License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes, in accordance with your subscription plan.
    • User Content: You retain ownership of any content you submit to the Service (e.g., bookmarks). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the operation of the Service.
    • Generated Content: The summaries and other content generated by the Service ("Generated Content") are provided for your use. You are granted a license to use the Generated Content for personal and internal business purposes. You are responsible for how you use the Generated Content and for ensuring it does not infringe on any third-party rights (such as the original video's copyright). ClarifyTube does not claim ownership of the Generated Content and is not liable for its accuracy or subsequent use.

    8. Privacy Policy

    Your privacy is important to us. Our Privacy Policy explains how we collect, use, and share your personal information. By using the Service, you agree to the collection and use of information in accordance with our Privacy Policy. We encourage you to read it carefully to understand our practices, including our use of third-party services like Stripe for payment processing and AI providers for generating summaries.

    We use cookies to enhance your experience on our Service. By using the Service, you consent to the use of cookies. For more details on how we use them, please review our Privacy Policy. We use cookies for various purposes, including:

ClarifyTube DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. ClarifyTube DOES NOT WARRANT THAT THE SUMMARIES GENERATED BY THE SERVICE WILL BE ACCURATE, COMPLETE, OR RELIABLE. YOU USE THE SERVICE AT YOUR OWN RISK.

    The Service relies on third-party services, including but not limited to YouTube and artificial intelligence providers. ClarifyTube is not responsible for the availability, accuracy, or functioning of these third-party services. Any interruption or issue with these services may affect the functionality of our Service, and we shall not be liable for any such disruptions.

    11. Limitation of Liability

    IN NO EVENT SHALL ClarifyTube, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT ClarifyTube HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

    12. Indemnification

    You agree to defend, indemnify, and hold harmless ClarifyTube, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party.

    13. Governing Law and Dispute Resolution

    These Terms shall be governed and construed in accordance with the laws of the jurisdiction where ClarifyTube is established, without regard to its conflict of law provisions. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of that jurisdiction.

    14. Changes to Terms

    We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

    16. Beta Program Disclaimer

    You acknowledge that you are participating in a beta test of the Service ("Beta Program"). The Service is currently in a testing phase and is being provided "AS IS" and "AS AVAILABLE." As a beta tester, you are expected to encounter bugs, errors, and unexpected behavior. ClarifyTube makes no warranties, express or implied, regarding the Beta Program, and your use of the Service during the Beta Program is at your sole risk. ClarifyTube shall not be liable for any damages arising from your participation in the Beta Program. By using the Service, you agree to act as a beta tester and accept the inherent risks associated with using pre-release software.
